Article 01
Definitions & Parties
"T.K.C.T Team" (hereinafter "the Company", "we", "us") refers to the venture holding entity operating under the brand T.K.C.T Team, inclusive of its three business verticals: Advisory & Operations, Career Strategy Lab by TKCT, and The Lifestyle Collection.
"User" (hereinafter "you", "Client") refers to any individual, legal entity, or representative who accesses, browses, engages with, or submits information through any digital or physical touchpoint operated by the Company.
"Services" refers to all consulting, advisory, career strategy, event, product, and lifestyle offerings provided by the Company or its affiliated verticals.
"Platform" refers to the website at tkctteam.org and any associated subdomains, microsites, or linked digital properties.
Article 02
Acceptance of Terms
By accessing the Platform or engaging with any Service, you confirm that you are at least 18 years of age and legally capable of entering into binding agreements under applicable law.
These Terms constitute a legally binding agreement. The Company reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform following any modification constitutes acceptance of the revised Terms.
The most current version of these Terms is always accessible at tkctteam.org/terms and supersedes all prior versions.
Article 03
Scope of Services
The Company operates three distinct business verticals. The scope of engagement, deliverables, pricing, and timelines for each are governed by separate Service Agreements executed prior to commencement of any work.
- Advisory & Operations: Strategic consulting, operational setup, project governance, and asset management advisory for institutional and individual investors.
- Career Strategy Lab by TKCT: Career repositioning programs, professional capital development, and human resource strategy for professionals and students.
- The Lifestyle Collection: Curated fine spirits, cigars, collector editions, and exclusive lifestyle events for discerning individuals and collectors.
Information published on the Platform is for general informational purposes only and does not constitute a binding offer, financial advice, investment recommendation, or guarantee of outcome.
Article 04
Intellectual Property Rights
All content on the Platform — including but not limited to brand identity, logos, typography, graphic elements, written content, structural design, photography, and code — is the exclusive intellectual property of T.K.C.T Team or its licensed partners.
You are strictly prohibited from:
- Reproducing, distributing, or creating derivative works from any Platform content without prior written consent
- Using any T.K.C.T Team trademark, logo, or brand identity in any manner implying affiliation or endorsement
- Scraping, crawling, or systematically extracting data from the Platform for commercial purposes
- Reverse engineering, decompiling, or disassembling any component of the Platform
Any unauthorized use constitutes an infringement and the Company reserves all legal remedies, including injunctive relief and claims for damages.
Article 05
Confidentiality & Non-Disclosure
In the course of engaging with the Company's Services, Clients may receive access to proprietary methodologies, strategic frameworks, business information, and non-public materials. All such information is strictly confidential.
- Not disclose any confidential information to any third party without the Company's prior written consent
- Use confidential information solely for the purpose of the agreed engagement
- Apply no less than reasonable care to protect the Company's confidential information
- Immediately notify the Company upon discovery of any unauthorized disclosure
These confidentiality obligations survive the termination of any Service Agreement for a period of three (3) years, or indefinitely with respect to trade secrets.
Article 06
Data Privacy & Personal Information
The Company collects and processes personal data strictly in accordance with applicable data protection laws. By submitting information through the Platform, you consent to the collection and use of your information for:
- Responding to inquiries and providing requested Services
- Internal business operations and service improvement
- Compliance with legal obligations
- Communication related to Services you have engaged or expressed interest in
The Company will not sell, rent, or trade your personal information to third parties. You retain the right to request access to, correction of, or deletion of your personal data by contacting admin@tkctteam.org.
Article 07
User Conduct & Prohibited Activities
- Submitting false, misleading, or fraudulent information through any Platform channel
- Attempting to gain unauthorized access to any part of the Platform or its underlying systems
- Transmitting malicious code, spam, or content designed to disrupt Platform operations
- Using the Platform in any manner that could damage the reputation or interests of the Company
- Impersonating any person, entity, or representative of the Company
- Engaging in any activity that violates applicable laws, regulations, or third-party rights
The Company reserves the right to terminate access, report violations to relevant authorities, and pursue legal action for any breach of this Article.
Article 08
Disclaimer of Warranties
The Platform and all content therein are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Company does not warrant that:
- The Platform will be uninterrupted, error-free, or free of harmful components
- Any information on the Platform is accurate, complete, or current
- Results obtained from using the Services will meet any specific expectations or objectives
Advisory content and strategic outputs provided by the Company represent professional judgment based on available information and do not constitute guarantees of financial, career, or business outcomes.
Article 09
Limitation of Liability
To the maximum extent permitted by applicable law, T.K.C.T Team and its principals, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Loss of profits, revenue, business opportunity, or data
- Damages arising from reliance on Platform content or Service outputs
- Third-party actions, products, or services linked to or accessible through the Platform
Total aggregate liability shall not exceed the amount paid by the Client for the specific Service in the three (3) months preceding the claim.
Article 10
Indemnification
You agree to indemnify and hold harmless T.K.C.T Team and its principals, officers, employees, and partners from any claims, liabilities, damages, and expenses (including legal fees) arising out of:
- Your use of or access to the Platform
- Your violation of these Terms or any applicable law
- Your infringement of any third-party rights, including intellectual property rights
- Any content you submit or transmit through the Platform
Article 11
Third-Party Links & External Platforms
The Platform may contain links to third-party websites or social media channels (including LinkedIn and Facebook). These links are provided for convenience only. The Company exercises no control over third-party content and accepts no responsibility for their accuracy, legality, or practices.
Accessing third-party platforms through links on this Platform is done entirely at your own risk and is subject to the terms of those respective platforms.
Article 12
Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the Socialist Republic of Vietnam. Any dispute shall be resolved as follows:
- Negotiation: Good-faith direct negotiation within thirty (30) days of written notice.
- Mediation: Non-binding mediation before a mutually agreed mediator if negotiation fails.
- Litigation: Exclusive jurisdiction of competent courts in Ho Chi Minh City, Vietnam.
Nothing herein prevents the Company from seeking emergency injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
Article 13
Termination & Suspension
The Company reserves the right, at its sole discretion and without prior notice, to terminate or suspend your access to the Platform or any Service for violation of these Terms, and to remove or modify any Platform content at any time.
Provisions that by their nature should survive termination — including confidentiality, intellectual property, limitation of liability, and dispute resolution — shall continue to apply.
Article 14
Severability & Waiver
If any provision of these Terms is found invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
The Company's failure to enforce any right shall not constitute a waiver. Any waiver must be in writing and signed by an authorized representative of the Company.
Article 15
Entire Agreement
These Terms, together with any separately executed Service Agreements, constitute the entire agreement between you and T.K.C.T Team with respect to the subject matter herein, and supersede all prior agreements, representations, and understandings.
In the event of any conflict between these Terms and a separately executed Service Agreement, the Service Agreement shall prevail for the specific engagement covered thereby.
